Yavapai Superior Court to Hear Lawsuit Over City Councilman’s Selection

A temporary restraining order filed last week against the City of Prescott concerning a city council appointment is heading to Yavapai County Superior Court.

Sherri Hanna, a former applicant for a vacant Prescott City Council seat earlier this year, is challenging the city’s appointment of Councilmember Patrick Grady on May 20, who filled the seat vacated by Cathey Rusing, who resigned in order to run for mayor. The filing contends the city violated the Prescott City Charter and open meeting law in the appointment process of Grady to the council, and lists Mayor Phil Goode, City Attorney Joseph Young, and council members Ted Gambogi, Brandon Montoya, Eric Moore, Connie Cantelme and Lois Fruwirth as defendants.

The filing requests the court declare the appointment of Grady to the council void and declare any city action which depended upon or was adopted by a one vote margin which included Councilman Grady’s vote also be declared null and void.

The first hearing in this matter has been set for Friday afternoon in Yavapai County Superior Court.
